These terms explain the legal agreement between you and Roam App, Inc., a Delaware corporation, with offices at 2261 Market Street STE 22495, San Francisco, CA, 94114, United States.

The essentials: You keep ownership of what you create. We need permission to operate the platform and improve it. You can opt out of helping train our AI. Be respectful and don't break the law. Pretty standard stuff.

By using Roam, you're agreeing to these terms. If something doesn't work for you, please don't use the app.

1. Apple Required Provisions

1.1 Acknowledgment

This Agreement is between you and Roam only, not with Apple Inc. ("Apple"). Roam, not Apple, is solely responsible for the Roam application and its content.

1.2 Scope of License

This license grants you a limited, non-transferable, non-exclusive license to install and use the Roam application on any Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

1.3 Maintenance and Support

Roam is solely responsible for providing maintenance and support services. Apple has no obligation to furnish any maintenance or support services.

1.4 Warranty

Roam is solely responsible for any product warranties, whether expressed or implied by law. In the event of any failure to conform to warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.

1.5 Product Claims

Roam, not Apple, is responsible for addressing any claims relating to the application or your use thereof, including: (a) product liability claims; (b) any claim that the application fails to conform to legal or regulatory requirements; and (c) claims arising under consumer protection or similar legislation.

1.6 Intellectual Property Rights

In the event of any third-party claim that the application or your possession and use of the application infringes that third party's intellectual property rights, Roam, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

1.7 Legal Compliance

You represent and warrant that: (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

1.9 Third-Party Terms

You must comply with applicable third-party terms when using the application.

1.10 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

2. The Service

2.1 What Roam Does

Roam is a mobile app that lets you create 3D video games using AI. You provide ideas, images, or videos, and Roam helps you build playable games. You can save, share, and play what you create.

2.2 Changes to the Service

We're constantly improving Roam—adding features, fixing bugs, and making things better. Sometimes we might remove or change features. We'll do our best to let you know about major changes, but we can't always give advance notice.

2.3 Experimental Features

Sometimes we'll release beta or early-access features for you to try. These are works in progress and might be unstable. If you get access to something marked as beta, please don't share details about it publicly—we want to get feedback from testers before launching to everyone.

3. Eligibility And Requirements

3.1 Age Requirements

Roam is rated 9+ and designed for a broad audience. However, different rules apply based on your age:

  • Users 13 and Older: You may create an account and use the Service, subject to this Agreement.

  • Users Under 13: You may only use the Service with verifiable parental consent. Your parent or legal guardian must review and accept this Agreement on your behalf. Child User accounts have restricted features and limited data collection as described in our Privacy Policy.

3.2 Parental Consent From Child Users

If you are a parent or guardian providing consent for a Child User:

  • You agree to this Agreement on behalf of your child

  • You are responsible for monitoring your child's use of the Service

  • You may review, delete, or request cessation of data collection by contacting hi@roam.fr

3.3 Feature Restrictions for Child Users

Child Users (under 13) have the following restrictions:

  • Social sharing features are disabled or heavily moderated

  • Direct messaging is disabled

  • Public profile features are limited

  • Content from Child Users is NOT used for AI training or Service improvement

  • Certain community features may be restricted

3.4 Additional Restrictions

Users under 18 may be subject to additional content restrictions and parental controls as determined by Roam in its sole discretion.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update such information to maintain its accuracy.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to immediately notify us of any unauthorized use of your account at hi@roam.fr.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of this Agreement, without prior notice or liability.

5. User Content And Licencing

5.1 User Content Ownership

You retain ownership of all content you create, upload, or submit to the Service, including prompts, images, videos, and games ("User Content").

5.2 License Grant to Roam

To operate the Service and provide features like sharing, showcasing, and continuous improvement, you grant Roam permission to use your User Content in the following ways:

(a) Operating and providing the Service to you and other users
(b) Improving Service quality, features, and performance
(c) Ensuring content safety and compliance with our policies
(d) Showcasing popular creations in galleries or promotional materials (with credit where feasible)
(e) Meeting our legal and regulatory obligations

This permission is worldwide, royalty-free, and lasts for as long as needed to provide these services. You retain full ownership of everything you create.

Child User Exception: Content created by users under 13 (Child Users) is NOT used for Service improvement, AI training, or any purpose beyond providing the core Service features to that child. Child User content is excluded from purposes (b) above.

5.3 Service Improvement

To make Roam better for everyone, we may use User Content to improve our AI technologies and Service quality. You can opt out of this improvement program in Settings > Privacy Controls. Opting out won't affect your ability to use any core features.

Child Users (Under 13): Content from Child Users is automatically excluded from Service improvement and AI training. It cannot be opted in.

5.4 User Content Representations

You represent and warrant that:

(a) You own or have the necessary rights to all User Content you submit
(b) Your User Content does not infringe any third-party intellectual property rights
(c) Your User Content complies with all applicable laws and this Agreement
(d) You have obtained all necessary consents, permissions, and releases for any individuals appearing in your User Content

5.5 Content Moderation

We actively moderate content to keep Roam safe for all users. We have zero tolerance for abusive, harmful, or objectionable content (see Section 6.1 for details).

We may review, remove, or restrict User Content at any time, with or without notice, if it violates this Agreement or our community standards. Violations may result in content removal, account suspension, or permanent ban.

If your content is removed by our automated moderation systems and you believe this was in error, you may request human review by contacting hi@roam.fr.

6. Prohibited Conduct

To keep Roam safe and fair for everyone, please don't:

(a) Violate any laws or regulations
(b) Infringe on anyone's intellectual property rights
(c) Upload harmful, illegal, threatening, abusive, harassing, or inappropriate content
(d) Upload content depicting minors in inappropriate contexts
(e) Impersonate others or misrepresent who you are
(f) Interfere with the Service or try to disrupt it for others
(g) Use bots, scrapers, or automated tools to extract data
(h) Try to reverse engineer, decompile, or hack the Service
(i) Use Roam to build competing products
(j) Use Roam's outputs to train competing AI systems
(k) Run unauthorized benchmarks or competitive analyses for publication
(l) Bypass security measures or usage limits
(m) Resell or sublicense access to Roam
(n) Harass, bully, or engage in hate speech
(o) Try to game or manipulate Roam's systems

We're building something special here—help us keep it that way.

6.1 Zero Tolerance for Abusive Content

We have zero tolerance for objectionable, abusive, or harmful content. This includes but is not limited to:

  • Content that promotes violence, terrorism, or extremism

  • Sexually explicit or pornographic material

  • Content that exploits or endangers children in any way

  • Hate speech targeting race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics

  • Content that promotes self-harm, suicide, or eating disorders

  • Harassment, bullying, doxxing, or threats against individuals

  • Graphic violence or gore

  • Spam, scams, or fraudulent content

Consequences: If you create, upload, or share prohibited content:

  • Your content will be immediately removed

  • Your account may be suspended or permanently banned

  • We may report illegal content to law enforcement

  • We reserve the right to take action without prior warning

Reporting: If you see content that violates these rules, please report it immediately through the app or by emailing hi@roam.fr. We review all reports promptly.

6.2 Reporting Violations

Help us keep Roam safe. If you encounter content or behavior that violates these terms:

In-App Reporting: Use the "Report" button on any content or user profile

Email Reports: Send details to hi@roam.fr with "Content Violation Report" in the subject line

What to Include:

  • Link to or description of the violating content

  • Which rule(s) were violated

  • Any additional context that helps us understand the issue

We investigate all reports within 24 hours and take appropriate action. You'll receive confirmation that we received your report, though we may not be able to share specific details about actions taken due to privacy considerations.

7. Intellectual Property Rights

7.1 Roam's Rights

The Service, including all software, algorithms, machine learning models, designs, text, graphics, interfaces, and other content provided by Roam, is owned by Roam and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Restrictions

You may not copy, modify, distribute, sell, or lease any part of the Service. You may not reverse engineer or attempt to extract source code from the Service unless expressly permitted by law.

7.3 Trademark

ROAM and associated logos are trademarks of Roam App, Inc. You may not use these trademarks without our prior written permission.

7.4 DMCA Copyright Policy

We respect intellectual property rights and respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA").

To submit a DMCA notice, please provide:

(a) A physical or electronic signature of the copyright owner or authorized representative
(b) Identification of the copyrighted work claimed to have been infringed
(c) Identification of the infringing material and information sufficient to locate it
(d) Your contact information (address, telephone number, email)
(e) A statement of good faith belief that use is not authorized
(f) A statement under penalty of perjury that the information is accurate and you are authorized to act

Repeat Infringer Policy: We will terminate accounts of users who are repeat infringers.

8. Subscribtions & Payments

8.1 Plans

Roam offers free and paid plans with different features and capabilities.

8.2 How Billing Works

Subscriptions are billed in advance—monthly, annually, or as specified in your plan. Apple charges your iTunes Account when you confirm your purchase.

8.3 Auto-Renewal

Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before your current period ends. Apple will charge your account within 24 hours before the end of your current period.

8.4 Managing Your Subscription

You can manage your subscription and turn off auto-renewal in your iTunes Account Settings after purchase.

8.5 Free Trials

If you start with a free trial, it converts to a paid subscription when the trial ends unless you cancel first. If you subscribe during a free trial, any unused trial time is forfeited.

8.6 Price Changes

We might adjust subscription prices from time to time. We'll give you at least 30 days notice before any price increase affects you.

8.7 Refunds

Payments are generally final. For App Store purchases, contact Apple at https://reportaproblem.apple.com to request a refund. We may offer refunds at our discretion in special circumstances.

8.8 In-App Purchases

You can buy virtual items or features within Roam. These purchases are final.

9. Privacy And Data Collection

9.1 Privacy Policy

Your privacy matters. Our Privacy Policy (incorporated into this Agreement by reference) explains what data we collect and how we use it. Please read it.

9.2 Service Improvement

We work with service providers to operate and improve Roam. This may include sharing data with partners who help with cloud infrastructure, analytics, authentication, and AI capabilities. All partners are required to protect your data and use it only for specified purposes.

9.3 Analytics

We collect usage data to understand how Roam is being used and to make it better. You can manage some tracking preferences in your device settings or within the app.

10. Disclaimers

Important legal stuff: Roam is provided "as is" and "as available." We work hard to make it great, but we can't guarantee it will always work perfectly or be available 100% of the time.

We don't make warranties about:

  • Uninterrupted or error-free service

  • Complete accuracy of AI-generated content

  • Security (though we take it seriously)

  • Third-party content or user creations

About AI-generated content: AI can make mistakes. Always review what Roam creates before using it. You're responsible for checking that generated content is appropriate and accurate for your needs.

User content: We're not responsible for what other users create or share. We moderate content, but we don't review everything before it's posted.

11. Limitation Of Liability

Legal limits: To the maximum extent the law allows, Roam's liability to you is limited. We're not liable for indirect damages like lost profits, lost data, or business interruption.

Our total liability for any claims won't exceed the greater of:

  • What you paid us in the past 12 months, or

  • $100

This applies regardless of the legal theory (warranty, contract, tort, etc.) and even if we knew damage was possible.

Why this matters: These limits let us offer Roam at reasonable prices while protecting our small company from unlimited liability.

12. Idemnification

You agree to indemnify, defend, and hold harmless Roam, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

(a) Your use of the Service
(b) Your User Content
(c) Your violation of this Agreement
(d) Your violation of any rights of another person or entity
(e) Your violation of any applicable laws or regulations

13. Dispute Resolution

13.1 Governing Law

Delaware law governs this Agreement.

13.2 Arbitration

If we have a dispute, we'll try to resolve it through binding arbitration rather than going to court. Arbitration is typically faster and less expensive than litigation.

The arbitration will be administered by the American Arbitration Association (AAA) under their Commercial Arbitration Rules. It can take place in San Francisco or remotely via video.

13.3 Exceptions to Arbitration

Either of us can still go to court for:

  • Protecting intellectual property rights

  • Small claims court cases that qualify

13.4 Individual Basis

Disputes will be resolved individually. This means no class actions or class-wide arbitrations—just you and Roam.

13.5 If Arbitration Doesn't Apply

For any claims not subject to arbitration, the state and federal courts in San Francisco County, California have exclusive jurisdiction.

14. Termination

14.1 Termination by You

You may terminate this Agreement at any time by discontinuing use of the Service and deleting your account.

14.2 Termination by Roam

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including:

  • Violation of this Agreement, particularly our zero-tolerance content policy

  • Creating, uploading, or sharing prohibited or abusive content

  • Repeated community guideline violations

  • Fraudulent or illegal activity

  • Non-payment of fees

We reserve the right to terminate accounts without warning for serious violations, especially those involving harmful, illegal, or abusive content.

14.3 Effect of Termination

Upon termination:

(a) Your right to use the Service immediately ceases
(b) We may delete your account and User Content
(c) Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability
(d) The license you granted to Roam for User Content shall survive termination

15. Export Controls

You agree to comply with all applicable export and import control laws and regulations. You may not use the Service if you are located in, or a resident of, any country subject to U.S. embargo or trade sanctions.

16. General Provisions

16.1 Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Roam regarding the Service.

16.2 Amendments

We may modify this Agreement at any time by posting a revised version on our website or within the application. Changes become effective upon posting. Your continued use constitutes acceptance of the modified Agreement.

16.3 Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.4 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

16.5 Assignment

You may not assign this Agreement without our prior written consent. We may assign this Agreement without restriction.

16.6 No Agency

Nothing in this Agreement creates a partnership, joint venture, or agency relationship.

5.3 Service Improvement

We may review, remove, or restrict User Content at any time, with or without notice, if it violates this Agreement or our community standards. Violations may result in content removal, account suspension, or permanent ban.

If your content is removed by our automated moderation systems and you believe this was in error, you may request human review by contacting hi@roam.fr.

6. Prohibited Conduct

To keep Roam safe and fair for everyone, please don't:

7. Intellectual Property Rights

7.1 Roam's Rights

The Service, including all software, algorithms, machine learning models, designs, text, graphics, interfaces, and other content provided by Roam, is owned by Roam and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Restrictions

You may not copy, modify, distribute, sell, or lease any part of the Service. You may not reverse engineer or attempt to extract source code from the Service unless expressly permitted by law.

7.3 Trademark

ROAM and associated logos are trademarks of Roam App, Inc. You may not use these trademarks without our prior written permission.

7.4 DMCA Copyright Policy

We respect intellectual property rights and respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA").

(f) A statement under penalty of perjury that the information is accurate and you are authorized to act

Repeat Infringer Policy: We will terminate accounts of users who are repeat infringers.

8. Subscribtions & Payments

8.1 Plans

Roam offers free and paid plans with different features and capabilities.

8.2 How Billing Works

Subscriptions are billed in advance—monthly, annually, or as specified in your plan. Apple charges your iTunes Account when you confirm your purchase.

8.3 Auto-Renewal

Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before your current period ends. Apple will charge your account within 24 hours before the end of your current period.

8.4 Managing Your Subscription

You can manage your subscription and turn off auto-renewal in your iTunes Account Settings after purchase.

8.5 Free Trials

If you start with a free trial, it converts to a paid subscription when the trial ends unless you cancel first. If you subscribe during a free trial, any unused trial time is forfeited.

8.6 Price Changes

We might adjust subscription prices from time to time. We'll give you at least 30 days notice before any price increase affects you.

8.7 Refunds

Payments are generally final. For App Store purchases, contact Apple at https://reportaproblem.apple.com to request a refund. We may offer refunds at our discretion in special circumstances.

8.8 In-App Purchases

You can buy virtual items or features within Roam. These purchases are final.

9. Privacy And Data Collection

9.1 Privacy Policy

Your privacy matters. Our Privacy Policy (incorporated into this Agreement by reference) explains what data we collect and how we use it. Please read it.

9.2 Service Improvement

We work with service providers to operate and improve Roam. This may include sharing data with partners who help with cloud infrastructure, analytics, authentication, and AI capabilities. All partners are required to protect your data and use it only for specified purposes.

9.3 Analytics

We collect usage data to understand how Roam is being used and to make it better. You can manage some tracking preferences in your device settings or within the app.

10. Disclaimers

Important legal stuff: Roam is provided "as is" and "as available." We work hard to make it great, but we can't guarantee it will always work perfectly or be available 100% of the time.

We don't make warranties about:

  • Uninterrupted or error-free service

  • Complete accuracy of AI-generated content

  • Security (though we take it seriously)

  • Third-party content or user creations

About AI-generated content: AI can make mistakes. Always review what Roam creates before using it. You're responsible for checking that generated content is appropriate and accurate for your needs.

User content: We're not responsible for what other users create or share. We moderate content, but we don't review everything before it's posted.

11. Limitation Of Liability

Legal limits: To the maximum extent the law allows, Roam's liability to you is limited. We're not liable for indirect damages like lost profits, lost data, or business interruption.

Our total liability for any claims won't exceed the greater of:

  • What you paid us in the past 12 months, or

  • $100

This applies regardless of the legal theory (warranty, contract, tort, etc.) and even if we knew damage was possible.

Why this matters: These limits let us offer Roam at reasonable prices while protecting our small company from unlimited liability.

12. Idemnification

You agree to indemnify, defend, and hold harmless Roam, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

(a) Your use of the Service
(b) Your User Content
(c) Your violation of this Agreement
(d) Your violation of any rights of another person or entity
(e) Your violation of any applicable laws or regulations

13. Dispute Resolution

13.1 Governing Law

Delaware law governs this Agreement.

13.2 Arbitration

If we have a dispute, we'll try to resolve it through binding arbitration rather than going to court. Arbitration is typically faster and less expensive than litigation.

The arbitration will be administered by the American Arbitration Association (AAA) under their Commercial Arbitration Rules. It can take place in San Francisco or remotely via video.

13.3 Exceptions to Arbitration

Either of us can still go to court for:

  • Protecting intellectual property rights

  • Small claims court cases that qualify

13.4 Individual Basis

Disputes will be resolved individually. This means no class actions or class-wide arbitrations—just you and Roam.

13.5 If Arbitration Doesn't Apply

For any claims not subject to arbitration, the state and federal courts in San Francisco County, California have exclusive jurisdiction.

14. Termination

14.1 Termination by You

You may terminate this Agreement at any time by discontinuing use of the Service and deleting your account.

14.2 Termination by Roam

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including:

  • Violation of this Agreement, particularly our zero-tolerance content policy

  • Creating, uploading, or sharing prohibited or abusive content

  • Repeated community guideline violations

  • Fraudulent or illegal activity

  • Non-payment of fees

We reserve the right to terminate accounts without warning for serious violations, especially those involving harmful, illegal, or abusive content.

14.3 Effect of Termination

Upon termination:

(a) Your right to use the Service immediately ceases
(b) We may delete your account and User Content
(c) Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability
(d) The license you granted to Roam for User Content shall survive termination

15. Export Controls

You agree to comply with all applicable export and import control laws and regulations. You may not use the Service if you are located in, or a resident of, any country subject to U.S. embargo or trade sanctions.

16. General Provisions

16.1 Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Roam regarding the Service.

16.2 Amendments

We may modify this Agreement at any time by posting a revised version on our website or within the application. Changes become effective upon posting. Your continued use constitutes acceptance of the modified Agreement.

16.3 Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.4 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

16.5 Assignment

You may not assign this Agreement without our prior written consent. We may assign this Agreement without restriction.

16.6 No Agency

Nothing in this Agreement creates a partnership, joint venture, or agency relationship.
